- We," "Us," "Our" refers to CFTS.CO (U) Ltd., registered in Uganda.
- You," "Your" refers to the client, customer, or the user of our services.
- Services" refers to our hosting, VPS, SaaS solutions, Colocation, and related offerings.
We strive to provide a 99% uptime guarantee, barring:
- Scheduled maintenance, which will be communicated in advance where possible.
- Third-party services/infrastructure failures.
- Internet outages, power grid failures, or upstream provider issues beyond our control.
- Force majeure events, including but not limited to natural disasters, civil unrest, and government-imposed restrictions, are beyond our control.
- Actions taken by end users, whether intentional (malicious activity, misconfiguration, unauthorized access) or unintentional (accidental deletion, improper use of resources), that impact service availability or user experience.
You agree not to use our services for any illegal activities, including but not limited to:
- Hosting or distributing malware, phishing scams, or unauthorized access tools.
- Using our services to gain unauthorized access to other networks or systems.
- Overloading or disrupting our infrastructure, including excessive use of system resources.
- Using automated tools, scripts, or software that negatively impact performance.
- Engaging in fraudulent, deceptive, or misleading activities using our services.
- Violating intellectual property laws or sending unsolicited bulk messages (spam).
- Violation of this clause may result in immediate suspension or termination of services without prior notice.
- VAT and local Excise Duties/Levies may apply and will be additional to the base cost.
- All fees are payable in advance unless otherwise agreed.
- Late payments may result in suspension, termination of services or interest being charged at unsecured loan rates subject on a case by case bases at CFTS discretion.
- Refunds are issued only at our discretion, except where required by law.
- Premature termination of a 'fixed-term' contract will nullify any and all discounts applied, and the full undiscounted cost will be retrospectively charged.
- We implement security measures to protect your data; however, absolute security cannot be guaranteed, and our responsibility is limited to platform and service availability.
- We offer optional backup services, which may be subject to additional fees.
- We are not liable for data loss resulting from end-user actions (intentional or unintentional), third-party breaches, or unforeseen circumstances beyond our control.
- We provide services "as-is" without warranties beyond those expressly stated.
- We are not liable for indirect, incidental, or consequential damages arising from service use.
- Our liability for any claim is solely at our discretion and is limited to the amount paid for the affected service in the past three months. Claims must be submitted via email within 7 days of the service disruption.
- If you breach these Terms.
- Upon request by law enforcement or government authorities.
- If payment obligations are not met.
- If your activities pose a risk to the stability or security of our services.
- Termination due to a breach of these Terms does not entitle the client to a refund.
To ensure fair use and optimal performance for all users:
- Excessive resource usage that negatively impacts other customers may result in service restrictions.
- We reserve the right to apply limits on bandwidth, CPU, and storage where necessary
- We may impose traffic management policies to prevent network congestion.
- These limitations do not apply to hybrid VPS guaranteed resource services, which have dedicated allocations.
- We provide customer support through email and phone. Response times may vary depending on request volume, complexity, and demand.
- For unmanaged services, support is provided on a best-effort basis and charged at $35.00 per hour, with a minimum charge of one hour per request. There are no incremental billing periods. Support is available only during standard working hours, Mon-Fri 0900-17:00h.
- For managed services, availability and terms are determined case-by-case and require a separate support agreement.
- Some of our services may include third-party integrations.
- We are not responsible for the availability, functionality, or security of third-party services or software.
- You acknowledge that third-party terms and conditions apply when using integrated services.
- CFTS reserves the right to modify these Terms at any time. Continued use of our services constitutes acceptance of any changes. Major changes will be communicated via email or our website.
